Scripps Mesa Conference Center (SMCC) Land Deed

Section 7 of the Addendum to Grant Deed/Exhibit “A” states:
Except as stated herein, Grantee and each Successive Owner, during its ownership of any portion of the Scripps Site will be bound hereby for the benefit of Grantor and the Benefitted Land; provided however, the benefits of these provisions pursuant to California CIVIL CODE Section 1468 shall not accrue to subsequent owners of the Benefitted Land unless Grantor expressly assigns such benefits by means of a recorded instrument.

Grantor = Miramar Ranch North (the “Benefitted Land”)
Grantee = San Diego Unified School District

Grantor provided design guidelines (terminated 12/31/2010) for the property site and requested:

Grantor desires that the design of the school be compatible with the surrounding community. Grantor’s representative shall be invited to and included in the design process. Conceptual, schematic and design development plans shall be submitted to the Grantor for review and comment. School District shall consider Grantor’s comments during the design process. In order to address Grantor’s concerns about design of the school the following guidelines are required: Landscape/Screening, Fencing, Building Build and Scale, Color and Materials, Roof Mounted Equipment Screening.
